Specific Terms: Export Manifest – IE547


  1. Applicability
    • 1.1.These terms and conditions (the “API Specific Terms and Conditions”) supplement the the General Terms and Conditions of NxtPort CVBA, registered with the Crossroads Bank of Enterprises under company number 0429.672.881 having its registered office at Brouwersvliet 33, Box 8, 2000 Antwerp (Belgium) (“NxtPort”) governing the use of the NxtPort platform (the “General Terms and Conditions”) and describe the terms and conditions under which a User (as defined in the General Terms and Conditions) can make use of the Digital Export Manifest service (hereafter the “Service ”) which is a service offered through the Platform.
    • 1.2.These Service Specific Terms and Conditions provide specific terms for the use of the Service and form an integral part of the General Terms and Conditions.


  2. Definitions
    • 2.1.Capitalized terms used in these Service Specific Terms and Conditions and not separately defined in these Service Specific Terms and Conditions, shall have the respective meanings ascribed to such terms in the General Terms and Conditions.


  3. Description of the Service
    • 3.1.The purpose of the Service is:
    • 3.1.1.to generate the Export Manifest (IE547) for containers and/or vehicles shipped out of the EU and for which a customs declaration has been made;
    • 3.1.2. to provide an online visualization allowing the Service User to validate the content of the Export Manifest and to approve delivery of it to Customs Authorities.
    • 3.1.3. to provide online monitoring of the Customs Respons.
    • 3.2.The Service unburdens shipping agents from having to develop and to deliver the Export Manifest themselves.


  4. Data
    • 4.1.The Service is making use of following data:
    • 4.1.1. the COARRI/Load message provided by the terminal at port of exit;
    • 4.1.2.the Customs status indicator in e-Desk for all containers/vehicles that were declared through the e-Desk.
    • 4.1.3. The Actual Time of Departure (“ATD”) of the related vessel as reported in APICS / C-point, powered by NxtPort.


  5. Fees and pricing
    • 5.1.Monthly fee for using the Service:
    • 5.1.1. A fee of € 35.00 per month (ex VAT) (€ 420.00/year (ex VAT)) per registered entity that uses Data or Services from the NxtPort platform.
    • 5.1.2. The amount will be invoiced the first time Data or Services will be used.
    • 5.1.3. If an entity only provides Data to the Platformwithout using any API’s or Services, the monthly fee is not applicable
    • 5.2.Data Fee
    • 5.2.1. By the inherent nature of this Service, there is no Data Fee applicable.
    • 5.3.Subsription Fee
    • 5.3.1.The Subscription Fee for Export Manifest (IE547) usage is based on the number of Export Manifests per year submitted to Customs Authorities, regardless of the amount of containers/vehicles per manifest and regardless of the number of messages to be submitted per call to Customs Authorities.
    • 5.3.2. To avoid monthly invoicing for this Service, the Export Manifest yearly prepaid amount is based on the User’s selection from below grid:

    • 5.3.3. The User of this Service selects the number of expected Export Manifests to be submitted to Customs Authorities during the year and prepays the corresponding amount.If at the end of the year the number of actual Export Manifests submitted is less than the tier the User has prepaid, the User will get a refund of the difference multiplied by the “Amount Per Export Manifest Less”.On the contrary, if the actual number of Export Manifests submitted would be higher than the tier prepaid, the User will have to pay for the difference multiplied by the “Amount Per Export Manifest More”.


  6. Accuracy
    • 6.1.The Service is dependent on the quality and accuracy of both the provisioning of the loading confirmations (COARRI/Load) and the Customs status indicator in e-Desk for all containers/vehicles that were declared through the e-Desk.
    • 6.2.NxtPort does not provide any warranty to the accuracy of the Service, other than a best efforts that the Service will accurately reflect the status of the loading confirmations (COARRI/Load) received and the Customs status indicator in e-Desk as indicated through e-Desk.


  7. Timeliness
    • 7.1.The User will request the terminal operater at the port of exit to provide a copy of COARRI/Load data within fifthteen (15) minutes after the physical move has been recorded in the terminal operator’s Terminal Operating System.
    • 7.2.The Export Manifest will be generated 6 hours after ATD and will be presented to the User in the online visualization tool.
    • 7.3.If the Customs status for containers/vehicles intended to leave the EU via the port of exit have not been recorded in the e-Desk application yet by the exporter or the appointed customs declarant, these containers/vehicles will have to be manually added by the User in the online tool.
    • 7.4.Until successful delivery at Customs Authorities, NxtPort will automatically submit this Export Manifest (IE547) three times prior to online flagging an issue at the online monitoring tool.


  8. Privacy
    • 8.1.If any of the Data provided by the Data Provider contains any Personal Data, such Personal Data will only be processed within the context of the Service in strict compliance with the Data Sharing Rules and the General Terms and Conditions.
